TERMS AND CONDITIONS OF CONTRACT – WINDOWS & DOORS

CONTRACT

Only these terms and conditions and the product details shown on the front page form the contract between us so it is important that you check to make sure everything you want is included. We have asked you to read these terms and sign on the front page to confirm that you agree to them.

 

You will be responsible for obtaining any planning consents or approvals applicable to the installation unless otherwise agreed and the appropriate fees have been paid. You are also responsible for notifying us of any special conditions or restrictions which apply to your property that restrict the replacement of your existing windows or doors such a listed properties etc.

 

CHANGES TO THE CONTRACT

If either of us wants to make any changes after this agreement has been signed we will both need to agree to them first. We will always confirm changes on a contract variation form for you to sign. Sometimes we may need to make minor technical changes to the product specification which is unavoidable and we will not notify you in such cases.

 

CANCELLATION

You may cancel this contract within 7 days of signing and ask for a refund of your deposit if the contract was signed away from our business premises. To cancel you must write to us at Ultimate Pvc Windows & Doors Ltd,Unit 17A Court Yard 3,Wentorth Road Mapplewell,Barnsley S75 6DT  making sure the cancellation reaches us in time.

 

If we cancel the contract we will refund your deposit to you. We may cancel it if (i) we cannot install the products properly following survey (ii) we cannot reach an agreement with you over our suggested changes after we have carried out the survey (iii) there is a breach of contract or refusal to comply with statutory requirements such as building regulations.

 

We may both cancel if the survey reveals unforeseen additional work at extra cost, or that your property is unsafe or unsuitable for the installation to be carried out.

 

SURVEY

We carry out a survey to make sure that what you have requested can be properly installed at your property. We will try and do this within 14 days and you agree to allow us access within 4 weeks unless we have otherwise agreed. If problems arise at survey we will notify you at the time.

INSTALLATION DATES

If any dates are shown on the front page these can be only estimates. We will let you know when the products are ready and agree an installation date with you. We will do our utmost to keep to this date but if a delay arises due to reasons beyond our control we will let you know and offer you the next earliest convenient date. We cannot accept time being of the essence in respect of installations.

 

If we have not completed the installation within 6 week of the date we both agree, you may write to us requesting that the installation is completed within a further 6 weeks or some other longer period to be agreed between us. If we have still not installed within this extended time, we will refund any money you have paid us for work we have not done.

 

You agree that we are not liable for any delay which arises from causes beyond our control, for example, fire, flood, civil disturbance, strikes, criminal damage and acts of war.

 

INSTALLATION

  1. We will remove and dispose of all the old windows and doors unless otherwise agreed.
  2. You must ensure that your belongings are removed and the area our installers need to work in is clear.
  3. You must that any cables, aerials, alarms, radiators, curtains and blinds etc are moved before our installers start work.
  4. We will use reasonable skill and care and approved working practices when installing the products. If we damage the fabric of the building in the immediate vicinity of the installation we will repair the damage or replace the item with as close a match as possible but we will not redecorate or re-tile.
  5. We cannot accept damage caused by subcontractors and any such sub-sequential losses should be claimed from the subcontractors own public liability insurances.

 

PAYMENT

When we have substantially completed the installation, our installers will walk round with you to check that you are satisfied with it. You must then pay our installers the balance shown in the “Total Payable to Installers” box. They will give you an invoice confirming the amount which should correspond with the agreed contract value including extras. Cheques should be made payable to “Ultimate Pvc Windows & Doors Ltd”. If you do not pay us at that time we will charge you interest at the rate of 4% above the Royal Bank of Scotland base rate on the outstanding amount.

 

We will retain ownership of any products which have yet to be fixed to your property until the full sales price has been paid.

 

If you do not allow us to install the products within 6 weeks of the installation date you agree to pay us 80% of the Sale Price shown on the front page and we will store the products for up to 12 weeks without charge.

 

GUARANTEES

We Guarantee to repair or replace (at our discretion) free of charge our PVCu and aluminium products and double glazed sealed glass units for 15 years from the date of installation if the materials are faulty or there is a defect caused by poor workmanship.

 

Despite the fact that your statutory rights remains unaffected, our guarantee will not apply and does not extend to:

  • Any product for which you have not paid the total sale price;
  • Minor imperfections in the glass outside the scope of the Glass & Glazing Federation’s (GGF) visual quality standards
  • Any defect arising from wear and tear, wilful or accidental damage, negligence, neglect, misuse, structural or latent defects at your property, or causes beyond our control;
  • Any product where work has been carried out by others outside Ultimate Pvc Windows & Doors Ltd;
  • Control or eliminations of any natural occurring condensation;
  • Letterbox or broken glass units after 12 months.
  • Damage caused by adverse weather conditions including loose trims, gutter brackets etc.

 

Subject to the above, we may agree to transfer a guarantee to a new owner of your property following a chargeable inspection and payment of our fees details of which are available upon application.

 

DISPUTES

We support the GGF’s Code of Good Practice and always try to work within its guidelines but if you have any issues with this contract please write to; Customer Services, Ultimate Pvc Windows & Doors Ltd Unit 17a Court Yard 3,Wentworth Road,Mapplewell,Barnsley,South Yorkshire,S75 6DT and we will do our best to resolve them in a reasonable way and within a reasonable time. If a dispute arises under this contract which we are unable to resolve between us, we can provide you with details of the GGF’s Arbitration Scheme which is administrated by the Chartered Institute of Arbitrators.
